(Attachments: #1 Exhibit A - Email from Defendant to Mr. Schiller)(Schiller, John) Modified on 3/5/2024 - not a motion (P,K). Modified exhibit text on 3/7/2024 (B,DL).
March 5, 2024 Opinion or Order Order [non-document] The Court has reviewed Plaintiff's Response to this Court's February 21, 2024 Order directing Plaintiff to demonstrate that service on Defendant Hall has been properly perfected under Fed. R. Civ. P. 4. (Doc. No. #5 .) The Court is satisfied with Plaintiff's Response. The docket reflects that Defendant Hall's Answer was due by February 16, 2024 and not filed. Accordingly, within thirty (30) days of the date of this Order, Plaintiff shall submit an appropriate application for entry of default and an affidavit in support thereof, or show cause why said Defendant Hall should not be dismissed for want of prosecution. Judge Pamela A. Barker on 3/5/2024. (P,K)
February 21, 2024 Opinion or Order Order [non-document] Upon review of the docket, the Court notes that the Complaint in this case was filed on January 23, 2024 against one defendant, an individual named Roger Hall. On January 26, 2024, Plaintiff filed a Return of Service Executed, in which Plaintiff provides documentation that the summons and complaint in this case were served via Fed Ex overnight delivery at Defendant Hall's Florida residence on January 25, 2024. The service documentation provided by Plaintiff (Doc. No. #4 at PageID#17) indicates that the service package was signed for by someone identified only as "R. Reh." It is not clear who "R.Reh" is; what his/her relation is to Defendant Hall; or whether "R. Reh" is over 18 years old. If properly served, Defendant Hall's Answer would have been due on February 16, 2024. No Answer has been filed, and no counsel has entered an appearance on Defendant Hall's behalf. By no later than March 6, 2024, Plaintiff shall demonstrate, with citation to relevant authority, that service on Defendant Hall has been properly perfected under Fed. R. Civ. P. 4. Judge Pamela A.
