Defendant's motion for summary judgment is granted with regard to its interpretation of § 8.6.2(b) of the parties Asset Purchase Agreement, denied with regard to its computation of the amount of revenue generated by plaintiffs' business during the year following its sale to defendant, and denied as to attorneys' fees.
