ORDER & NOTICE OF CASE DISMISSAL Oral Argument held 7/15/09. Pltf's motion to remand is denied 16 The Court granted Continental's motion to stay 9 condition on the filing of a $1,200,000 surety bond with the Clerk of Court w ithin 10 days. The Court granted pltf's oral motion to dismiss counts 2&3 of the supplemental complaint w/out prejudice, thus deft's motion for partial dismissal 10 is denied as moot. This order supplements the court's oral ruling. This case is ordered closed statistically pending the outcome of the appeal in the underlying case.
