The eight CBP encounters over a period of 6 years that were the focus of testimony at trial do not support the allegation that CBP has a policy or custom of racial profiling and unlawful seizures. Plaintiffs hav e not shown by a preponderance of the evidence that Defendant committed any constitutional violations, or that any of the alleged violations were the result of Defendant's custom or policy.
