Rodriguez's second and third grounds for relief are dismissed as procedurally defa ulted. Rodriguez's first ground for relief is dismissed as not being cognizable in habeas proceedings. Rodriguez's entire petition is denied and dismissed with prejudice. Further, the Court certifies that an appeal from this decision could not be taken in good faith and that there is no basis upon which to issue a certificate of appealability. 28 U.S.C.
