Filing 139 Amended Memorandum Opinion and Order: Defendants' motion for summary judgment, (Doc. No.86), is granted in part and denied in part. The Defendants are entitled to summary judgment on the following claims: (1) under the Fourth Amendment fo r wrongful arrest and malicious prosecution; (2) assault, battery, wrongful arrest, false imprisonment, and malicious prosecution pursuant to statelaw; and (3) the Fourth Amendment claims against the PCSD under Monell v. Dept of Soc. Servs. The Defen dants are not entitled to summary judgment on the Plaintiffs claims (1) under the Fourth Amendment for unlawful entry and use of excessive force; (2) under the Fourteenth Amendment for deliberate indifference to medical needs; and (3) for failure to provide medical care and loss ofconsortium pursuant to state law.
