Filing 34 Memorandum Opinion and Order granting 25 Defendants' Motion for Summary Judgment. This Court certifies, pursuant to 28 U.S.C. §1915, that an appeal from this decision could not be taken in good faith. Plaintiff's alternative Motion for Continuance 28 to conduct discovery is denied. The discovery Plaintiff seeks would have no bearing on this court's conclusion that Plaintiff failed to exhaust his administrative remedies. Judge Jack Zouhary on 8/23/2013. (D,L) |
Filing 12 Memorandum Opinion and Order: Plaintiff's Motion (Doc. 11 ) is granted. Because the U.S. Marshals Service is required to take reasonable efforts to effect service for a plaintiff proceeding in forma pauperis, and it is a reasonable step to obtain Defendants' last known addresses from ToCI, the Marshals shall obtain Defendants' last known addresses from ToCI and attempt to effect service. Further, the Marshals shall take every step to maintain the confidence of these addresses. Judge Jack Zouhary on 1/16/13. (C,D) |

This action shall proceed solely on Plaintiff's Eighth Amendment deliberate indifference claims against Kenny, Hostetler, and John in their individual capacities. The Clerk's Office is directed to forward the appropriate documents to the U.S. Marshal for service of process and shall include a copy of this Order in the documents to be served upon Kenny, Hostetler, and Johnson.
