The motions for summary judgment of Troopers Gatchel and Edelbrock, and Deputy Brock (Docs. 69 , 77 ), be, and the same her eby are, granted in their entirety. The motions for summary judgment of Deputies Geiger and Lee, Sergeant Hart and Officer Evilsizer (Docs. 66 , 67 , 77 ) on plaintiffs' First/Fourteenth Amendment claim (Count IV) be, and the same hereby are , granted. The motion for summary judgment of Officer Evilsizer on plaintiffs' Fourth/Fourteenth excessive use of force claim (Count I) be, and the same hereby is, denied. The motion for summary judgment of Officer Evilsizer on plaintiffs' Fourth/Fourteenth unlawful arrest and detention claim (Count III) be, and thesame hereby is, granted. The motions for summary judgment of Deputies Geiger and Lee, and Sergeant Hart (Docs. 67 , 77 ) on plaintiffs' Fourth/Fourteenth unlawful arrest and detention and excessive use of force claims (Counts I and III) be, and the same hereby are, denied. Count II (failure to intervene), as to all on scene officer movants, without prejudice; b.) Count V (conspiracy) as to all on scene off icer movants, without prejudice; c.) Counts VI and VII (state tort law claims) as to defendants Gatchel and Edelbrock with prejudice as to further proceedings in this court and case, and the other on scene movants without prejudice; and d.) Count VII I as to the supervisory defendants with prejudice as to derivative liability for the on scene actions of their subordinates and without prejudice as to claims of failure to train; and e.) As to the governmental entity defendants without prejudice. Defendants motions to dismiss be, and the same hereby otherwise are overruled.
