Memorandum Order: I reject in part and adopt in part Magistrate Judge Vecchiarelli's R & R, concurring in her recommendation that Martinez's habeas petition be dismissed. (Doc. No. 45). Further, I certify, pursuant to 28 U.S.C. 167; 1915(a)(3), that an appeal from this decision could not be taken in good faith, and that there is no basis upon which to issue a certificate of appealability. 28 U.S.C. § 2253(c); Fed. R. App. P. 22(b). Martinez's remaining outstanding motions for an evidentiary hearing and for the appointment of counsel are denied as moot. (Doc. Nos. 63, 69). 45 . Judge Jeffrey J.
