Plaintiff is precluded from making argument that Defendant was negligent in failing to install a shelf or storage locker (or anyth ing else) on the locomotive to hold water bottles under the LIA, or under the FELA due to preclusion. Plaintiff, however, can proceed on his general negligence claim under the FELA that Defendant was negligent in its placement of the box behind the seat. Magistrate Judge James R.
