Memorandum Opinion and Order Petition for writ of habeas corpus is dismissed w/out prejudice. Pursuant to 28 USC 1915(a) and 2253(c), this court certifies that an appeal from this action could not be taken in good faith and that petitioner has failed to make a substantial showing of the denial of a constitutional right. The Court declines to issue a certificate of appealability. Petitioner's Motion to proceed ifp (doc#5) and Motion for appt of counsel (doc#6) are denied as moot. Judge Jack Zouhary on 10/22/09.
