Memorandum Opinion and Order: Plaintiff's motion for injunctive relief and default judgment (Doc. 27 ) is denied, and defendant's motion to dismiss (Doc. 25 ) is granted in part, in so far as it seeks dismissal pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. The remainder of defendant's motion, which seeks dismissal pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, is moot. This case is dismissed. Judge Sara Lioi on 10/11/2011. (P,G)

Order: Immigration & Customs Enforcement (ICE), Special Operations Response Teams (SORT), Tennessee Bureau of Investigation (TBI), Warren County Sheriff's Office, Drug Enforcement Administration (DEA) and Federal Bureau of Investigation ( FBI) are dismissed as party defendants. The cause of action for malicious abuse of process is also dismissed. The FTCA claim remains against the United States. The Clerk's Office is directed to forward the appropriate documents to the U.S. Marshal for service of process.
