Memorandum Opinion and Order. For the reasons stated within Philip Tunanidas' petition under 28 U.S.C § 2241 is dismissed. Because Petitioner challenges the detainers against him rather than the sentence for which he is currently incarcerated, he is not in custody and therefore his Petition pursuant to §2241 is DISMISSED. The Court finds that Petitioner has failed to exhaust his Interstate Agreement on Detainers (IAD) remedies as described within and therefore dismisses the petition pursuant to 28 U.S.C. Section 2243.
