Judgment Entry that the reasons contained in the 111 Memorandum Opinion and Order filed contemporaneously herewith,that the Plaintiff U.S. Commodity Futures Trading Commission' motion for summary judgment against defendants Globa l Strategic Marketing, LLC and Patrick Cole is GRANTED. The following relief is ordered in favor of Plaintiff U.S. Commodity Futures Trading Commission and against defendants Global Strategic Marketing, LLC and Patrick Cole as follows: 1. Defendan ts Global Strategic Marketing, LLC and Patrick Cole are permanently enjoined as set forth in an Order of Permanent Injunction separately published; 2. Defendants Global Strategic Marketing, LLC and Patrick Cole are hereby jointly and severally liable for disgorgement of sums received by defendants in connection with defendants' violations of the Act in the amount of $ 1,146,399, plus pre-judgment and post-judgment interest, such sums to be paid immediately to Plaintiff U.S. Commodity F utures Trading Commission; and 3. Defendants Global Strategic Marketing, LLC and Patrick Cole are hereby jointly and severally liable for a civil monetary penalty in connection with defendants' violations of the Act in the amount of $ 1,1 46,399, plus pre-judgment and postjudgment interest, such sums to be paid immediately to Plaintiff U.S. Commodity Futures Trading Commission. Relief Defendant RAK Palace Rent-A-Car shall be dismissed from this action for failure of prosecution. Defendants Global Strategic Marketing, LLC's and Patrick Cole's cross-claims against defendants Complete Developments, LLC, Keelan Harris, Kevin Harris, Investment International Inc. and Karen Starr shall be dismissed from this action for failure of prosecution. Memorandum Opinion and Order: Plaintiff U.S. Commodity Futures Trading Commission's 77 Motion for default judgment against Defendants Complete Developments LLC, Investment International Inc., Kevin Harris, Keelan Harris and K aren Starr and against Relief Defendants Majestic Enterprises Collision Repair Inc., and UCAN Overseas Corporation, S.A., is GRANTED. Keelan Harris, Kevin Harris and Starr shall pay civil penalties as follows: Keelan Harris: $2.49 million; Kevin Harris: $ 2.49 million; and Starr $2.64 million. Any amounts received in payment from Keelan Harris, Kevin Harris or Starr shall be used to pay restitution first, and only upon the satisfaction of the restitution award, be applied toward the payment of civil penalties.
