The United States is dismissed as a party to this action. The Motio n to Dismiss (ECF No. 4 ) is denied as to Plaintiff's claim asserting a violation of the Fourth Amendment. This case shall proceed solely on Plaintiff's claim against Defendant United States Marshal Bill Boldin.
