Filing 67 Memorandum Opinion and Order: Plaintiff's motion for extension of time to file an opposition to defendants' initial motion to dismiss is denied. (Doc. No. 64 .) The Court shall not and does not accept plaintiff's motion in opp osition to defendants' motion to dismiss. Defendants' motion to dismiss and/or motion for summary judgment is denied. (Doc. No. 55 .) Plaintiff is not required to file an affidavit of merit in this case. To the extent that defendants have made a motion to dismiss based on plaintiff's lack of Rule 26 expert disclosures, the motion is denied without prejudice.
