Filing 25 Memorandum of Opinion. The Court considers Plaintiff's failure to file any opposition to Defendants' 10 and 20 motions to dismiss to be a "confession" to the merits of the Motions; accordingly the motions are granted and the Complaint is dismissed for failure to state a claim on which relief can be granted. Because the complaint is dismissed in its entirety, the motion for summary judgment is denied as moot. The Court certifies that an appeal from this decision could not be taken in good faith.
