Memorandum Opinion and Order: Finding that the Court lacks subject matter jurisdiction over the U.S. Department of Agriculture, Farm Service Agency, the U.S. Department of Agriculture, Farm Service Agency, is dismissed from this action. (Doc. No. 8 ). Also pending before the Court is plaintiff's motion to remand this case to the Trumbull County Court of Common Pleas on the grounds there is no basis for federal jurisdiction over this action if the Department is no longer a party. (Doc. No. 9 .) Accordingly, plaintiff's motion to remand is granted. This case shall be remanded to the Trumbull County Court of Common Pleas. Judge Sara Lioi on 10/29/2015. (P,J)
