Filing 62 Memorandum of Opinion and Order For the reasons set forth herein, Defendants' Motion to Dismiss (ECF No. 53 ), construed in part as a motion for summary judgment, is granted and all of Plaintiff's claims are dismissed with prejudic e. Plaintiff's Motion for Appointment of Counsel (ECF No. 56 ) is denied; and Plaintiff's Motion for Extension of Time (ECF No. 58 ) and Motion to Admit into Evidence (ECF No. 61 ) are denied as unnecessary.
