April 16, 2018 Opinion or Order Filing 12 Memorandum Opinion and Order: Plaintiff's motion for leave to amend (Doc. No. 7 ) is granted, and defendants' motion to dismiss (Doc. No. 4 ) and plaintiff's motion to certify the class based on the original complaint (Doc. No . 6 ) are denied without prejudice. However, in light of the fact that defendants opposed the motion to amend on futility grounds, the Court shall permit defendants leave until April 27, 2018 to file a motion to dismiss the amended complaint. Should any part of the amended complaint survive defendants' renewed Rule 12(b)(6) motion, or should defendants elect not to seek dismissal, the Court shall schedule this matter for a case management conference, at which time the parties may discuss a briefing schedule for a renewed motion to certify the class.
