Memorandum Opinion and Order: The Court has reviewed the Report and Recommendation and adopts the same, except to the extent it implies or suggests that one or more of the Escort Officers did, in fact, violate Manleys constitutional rights du ring the escort, as that is an issue for a factfinder to decide. Accordingly, defendants motion for summary judgment is: (1) GRANTED as to Manleys allegations against all defendants for acts committed leading up to and during his extraction from his cell; and (2) GRANTED as to all defendants, except Williams, Shannon, and Filipowicz, as to Manleys allegation that an officer intentionally injured his finger while he was being escorted to R&D. The case will proceed solely against defendants Willia ms, Shannon, and Filipowicz as to this allegation. Finally, under 28 U.S.C. 1915(e)(1), the Court may appoint an attorney to represent any person unable to afford counsel. The issues presented for trial in this case are sufficiently complex that pro se plaintiff Manley would benefit from counsel. As such, the Court would consider a request from Manley for an attorney to represent him in this matter. Judge Sara Lioi on 12/31/2019. (D,N)

Memorandum Opinion and Order: The Court dismisses the plaintiff's complaint against the Ohio Department of Correction & Rehab pursuant to 28 U.S.C. Section 1915(e)(2)(B) and 1915(A). This action shall proceed against the remaining defend ants: L. Hughes, W. Wine, M. Filipowicz, Jo Hall, J. Seech, J. Shannon, M. Williams, T. Dotson, M. Stevens, and M. Robinson. The Clerk's Office is directed to forward the appropriate documents to the U.S. Marshal for service of process upon the defendants listed above, and a copy of this Order shall be included in the documents served. The Court further certifies pursuant to 28 U.S.C. Section 1915(a)(3) that an appeal from this decision could not be taken in good faith. (Related Doc. No. 1 ). Judge Sara Lioi on 9/21/2018. (P,J)
