Filing 7 Order For the reasons set forth herein, the Court will convert Defendant's Motion to Dismiss for Lack of Jurisdiction (ECF No. #3 ) to one seeking summary judgment. Defendant shall answer the Complaint within 1 business day. Within 21 days, the parties shall file a joint stipulation of material facts, a joint exhibit list for the purpose of resolving the motion, and may each file an additional brief, not to exceed 10 pages per side, in support of their respective positions. If either side believes an exchange of documents or other discovery is needed to resolve the motion, counsel shall work cooperatively to exchange such discovery in advance of the 21-day cutoff.
