Filing 7 Order: This matter is before the Court upon plaintiff's Motion for a Preliminary Injunction (Doc. #3 ). In his motion, plaintiff alleges that he is not receiving chemotherapy. The motion is DENIED. Plaintiff was unable to attend the telephonic status conference set in this matter because he was off-site receiving chemotherapy. Because plaintiff is currently undergoing treatment, the Court finds that plaintiff cannot establish a likelihood of success on the merits.
