Order Approving Stipulation The parties' Stipulation (ECF No. #10 ) is hereby approved. The cutoff date for a putative class member(s) to file (through their retained counsel) a motion(s) to serve as lead plaintiff is 9/25/2023 - the statutory motion cutoff date. The Court will have until 10/25/2023 (90 days from the date of the published notice required by 78u-4(a)(3)(A)(i)) to "consider any motion made by a purported class member" and appoint "as lead plaintiff the member or members of the purported plaintiff class that the court determines to be most capable of adequately representing the interests of class members." In addition, as part of this process, the Court will have the opportunity to review and approve the appointed lead plaintiff's selection of counsel (i.e., as "lead counsel"). Within 30 days of being appointed, the lead plaintiff may timely file an amended complaint, which would serve as the operative complaint, and which Defendants may then timely move to dismiss.
