April 29, 2026 Opinion or Order Filing 29 Order of Dismissal On 4/28/2026, Plaintiffs notified the Court that, pending state probate court proceedings, they have reached a settlement with Defendants Catholic Diocese of Youngstown, Ursuline High School, and Margaret Damore (collectively, "Diocese Defendants"). ECF No. #28 . Accordingly, the docket shall be marked "settled and dismissed without prejudice" for all claims against them. Within 3 days of the finalization of state probate court proceedings, Plaintiffs and Diocese Defendants shall submit an executed stipulation and proposed order of dismissal with prejudice which, if approved, will supersede this Order. February 4, 2026 Filing 18 Case Management Conference Plan/Order. Case is assigned to the standard track, and is not currently suitable for Alternative Dispute Resolution (ADR). The Parties do not consent to the jurisdiction of the U.S. Magistrate Judge. The cutoff for completion of non-expert discovery is 9/14/2026. The need for expert discovery and any cutoffs for expert discovery will be discussed at the Status Conference to be held on 6/3/2026. Counsel shall comply with Local Rule 37.1, which outlines a process for resolution of discovery disputes. The Parties informed the Court that they have reached an approved agreement regarding the handling of disclosed privileged material. Plaintiffs' counsel shall docket that agreement for approval no later than 2/11/2026. The cutoff for filing dispositive motions is 11/2/2026, with responses due no later than 12/2/2026, and replies no later than `12/16/2026. Written stipulations as to all uncontested facts to be presented by the dispositive motion shall be filed with the Court along with the dispositive motion. If there are no stipulations, a joint notice stating same shall be filed by the same date. These are mandatory requirements. An expert report, if any, will be due 30 days after any ruling on a Fed. R. Civ. P. 56 motion. A Telephonic Status Conference is set for 6/3/2026 at 11:00 a.m. Counsel for Plaintiffs shall initiate the conference call by joining the other participants and calling the Court at (330) 884-7435. Present were Attorneys Subodh Chandra, Alexandra Lavelle, and Martin Desmond as counsel for Plaintiffs; Attorneys Justin Greenfelder, Victor Geraci, and Jacob Kelly as counsel for Defendants; Plaintiffs Grandmother Doe and Grandson Doe; Defendant Margaret Damore; Matthew Sammartino as representative for Defendant Ursuline High School; and Dr. Steven Jones and Patrick Kelly as representatives for Defendant Catholic Diocese of Youngstown. The Parties discussed the proposed case management plan, potential mediation, estimated fees for Plaintiffs' counsel, and the economies or redundancies relative to discovery available from pending cases 4:25-CV-1822 and 4:25-CV-1895 and the need for expert witnesses. The Parties do not agree on pursuing alternative dispute resolution at this time. No amended pleadings are anticipated. (3) Plaintiffs' counsel shall remove all blogs or other posts relating to these cases from their firm's website no later than 12/20/2025. (4) Defendants' counsel shall remove any similar text, should it exist, by 12/20/2025. (5) Any Party or Attorney in these cases who violates the provisions of this Order shall be ordered to show cause as to why they should not be held in contempt.
