June 25, 2026 Opinion or Order Order [non-document] The Court has reviewed the habeas petition and finds that Petitioner was living in the United States for at least one year before placed in custody without a bond hearing, and that Petitioner has no administratively final order of removal. (ECF #1 ) Consistent with this Court's prior orders and the Sixth Circuit decision of Lopez-Campos v. Raycraft, 175 F.4th 713 (6th Cir. 2026), the Court orders that, on or before Thursday, July 2, 2026, Respondents must: (1) provide Petitioner with an individualized bond hearing, pursuant to 8 U.S.C. 1226(a) at which the Government shall bear the burden of proof by clear and convincing evidence of justifying Petitioner's continued detention; or (2) release Petitioner from custody. The Court further orders Respondents to file a status report certifying compliance with this Order on or before 12:00 p.m. on July 7, 2026.
