Filing 102 Memorandum Opinion and Order regarding the issues remaining in this case. The Court concludes as follows: Pace is entitled to recover from the defendants and counter-defendants, jointly and severally, the amount of $500,000.00 in compen satory damages. Pace is entitled to prejudgment interest from December 15, 2007 until the date of the final judgment. Pace is entitled to its costs, subject to proper objections by the defendants and counter-defendants following the filing of appro priately supported Bill of Costs. Pace is not entitled to an award of attorneys' fees. In light of the rulings, Pace shall submit its properly supported Bill of Costs by no later than 12/1/2010. Defendants shall submit any objections or state in writing there are no objections by 12/10/10. No reply will be permitted. The Court will thereafter issue an award of costs, as appropriate. Seven days after the Court rules on the Bill of Costs, the parties shall jointly submit a proposed Final Judgment Entry incorporating all of this Court's rulings to date. (Related documents 96 99 ). Filing 93 Memorandum Opinion and Order granting in part and denying in part plaintiffs' motion for summary judgment (Related Doc # 89 ) as follows: summary judgment is granted in favor of plaintiffs Pace Airlines, LLC and Pace Airlines II, LLC aga inst defendants Professional Settlement Services, LLC, Susan A. Mannarino and Marilyn A. Mannarino on Counts One, Two, Three, and Five of the First Amended Complaint, and denied on Count Four of the First Amended Complaint; summary judgment is grante d in favor of counter-claimants Pace Airlines, LLC and Pace Airlines II, LLC against counter-defendants Global USA Holding, Inc., Bruce Gillette and John H. Kunkel on Counts One, Two and Three of the First Amended Counterclaim; summary judgment is gr anted in favor of cross-defendants Pace Airlines, LLC and Pace Airlines II, LLC on Counts One and Two of the Crossclaim and both of these counts are dismissed with prejudice; and plaintiffs are not entitled to recover punitive damages as a matter of law. In view of the Court's decision, which requires a trial on compensatory damages and other relief, and because the Third-Party Complaint has not been adjudicated, the Court needs to determine the course of subsequent proceedings. Accordingly, the Court hereby schedules a telephone status conference, with counsel only, for Wednesday, February 10, 2010 at 9:00 a.m. Counsel for Pace shall initiate the call.
