Filing 78 Memorandum Opinion: Based upon the facts of this case and for the following reasons, the Court denies 63 Rafi's motion for summary judgment and grants 61 the Candage's motion for summary judgment (see Order for details). Furthe rmore, the payment of the proceeds is stayed for a period of forty (40) days from the date of this Order. After the forty (40) day period, the Clerk is directed to release the funds held in the registry of the Court to Robert D. Candage as the lawfu l beneficiary to the proceeds of the Policy. If an appeal is filed, the Court will consider a motion for a stay with respect to the distribution of funds upon a showing of good cause. Each party shall bear their own costs.
