April 12, 2011 Opinion or Order Filing 13 Memorandum Opinion and Order: Mr. Swartz's Motion to Amend Complaint is granted only as to the remaining defendant, Oracle, and the Motions to Dismiss filed by Oracle (Doc. No. 7, Case 1) and Ariba (Doc. No. 7 , Case 2) are granted. Bot h cases are dismissed and all claims against Ariba are dismissed without prejudice, based on a lack of personal jurisdiction. The Court certifies, pursuant to 28 U.S.C. Section 1915(a)(3), that an appeal from this decision could not be taken in good faith. Judge Sara Lioi on 4/12/2011. (P,J)
