Order : The Court grants Goodyears Motion for Summary Judgment and denies Wackenhuts Motion for Summary Judgment ( 16 and 17 ). The parties shall appear before the Court on January 31, 2013, at 9:00 a.m. for a hearing on Goodyears claims fo r damages, which shall include the costs incurred in this litigation to seek enforcement of the indemnification agreement.
