Memorandum Opinion and Order: The City's motion for summary judgment on claim five is granted. The only claims now remaining for trial are Gradisher's claim of excessive force against Officer Craft (claim 1) and, to the extent they relate to the tasing, the state law claims against Craft of assault and battery (claim 8), gross neglect (claim 9), and intentional infliction of emotional distress (claim 11).
