Filing 12 Memorandum Opinion and Order: Ocwen's unopposed motion to dismiss is granted in part and denied in part. Collier's RESPA, TILA, and OPCA claims (counts one, seven, and eight) and his claims for negligent and/or intentional misreprese ntations (counts four and ten), breach of fiduciary duty (count five), breach of contract (count nine), and conspiracy to commit fraud (count eleven) are dismissed. Further, the portion of count six alleging a civil conspiracy to refuse to release fu nds and charging interest on unreleased funds is also dismissed. This case shall proceed therefore only as to Collier's claims alleging violations of OCSPA (counts two and three), a civil conspiracy between Ocwen and the unidentified Does (remainder of count six), conversion (count twelve), and negligent and intentional infliction of emotional distress (counts thirteen and fourteen).
