Accordingly, plaintiff's complaint is dismissed without prejudice for failure to prosecute. The Order of Dismissal filed on February 26, 2015, Doc. No. 17 , is vacated. This case is closed. Memorandum Opinion and Order: Defendants Canton Police Department and Officer Shackle are dismissed pursuant to 28 U.S.C. Section 1915(e). The Court certifies pursuant to 28 U.S.C. Section 1915(a)(3) that an appeal from their dismissal could n ot be taken in good faith. The Clerk's Office is directed to forward the appropriate documents to the U.S. Marshal for service of process on Officer Legg. A copy of this order shall be included with the documents to be served on him. Judge Sara Lioi on 10/30/2014. (P,J)
