September 30, 2016	Filing 88 Order granting in part and denying in part Defendant Village Plastics' Motion for partial summary judgment (Related Doc # 56 ); denying Plaintiff's Motion for leave to file a sur-reply (Related Doc # 74 ); denying Plaintiff's Motion for an order allowing limited discovery (Related Doc # 74 ). Based upon the reasons stated herein, this Court has resolved Count 8 by declaring the scope of the Release and the rights and obligations of the parties under the agreement. Furt her, in accordance with the scope of the Release, and the facts presented according to Fed.R.Civ.P. 56, there are no genuine issues of material fact as to Counts 5, 7, and 9 through 13. Thus, summary judgment is GRANTED on these claims. However, the Court DENIES judgment as a matter of law on Count 1. As such, the only remaining claims in this case are Counts 1 and 2. Judge John R. Filing 88 Order granting in part and denying in part Defendant Village Plastics' Motion for partial summary judgment (Related Doc # 56 ); denying Plaintiff's Motion for leave to file a sur-reply (Related Doc # 74 ); denying Plaintiff's Motion for an order allowing limited discovery (Related Doc # 74 ). Based upon the reasons stated herein, this Court has resolved Count 8 by declaring the scope of the Release and the rights and obligations of the parties under the agreement.
