Reviewing the facts in a light most favorable to Plaintiffs, genuine issues of material fact exist as to Plaintiffs' claims under the Fair Labor Standards Act. Therefore, Defendant's 104 motion for summary judg ment is Denied. Also, both sides argue that the other side has violated the discovery plan and submitted evidence outside of the parties' agreement.
