Filing 49 Memorandum Opinion: Defendant Motor Home Specialist LP's motion to dismiss and motion to exceed page limitations, are granted. (Doc. Nos. 6 and 43 .) Plaintiffs' motion to amend the complaint is denied. (Doc. No. 30 .) Defendant Jayco's motion for summary judgment (Doc. No. 18 ) is granted in part and denied in part, as follows: (1) With respect to plaintiffs' first and second claim, the motion is granted; (2) With respect to plaintiffs' third claim, the moti on is denied as to plaintiffs' claim for violation of the Texas Deceptive Trade Practices Act; denied as to plaintiffs' claim that Jayco violated the CSPA when it represented that repairs to the RV were made when they were not; and granted in all other respects; (3) With respect to whether plaintiff Chuck Nicholson lacks standing, the motion is granted.
