April 11, 2016	Filing 25 Memorandum Opinion and Order: The Court concludes that defendants have not satisfied their burden to show that plaintiffs abandoned their claims against the Ohio defendants. Plaintiffs' motion to remand is granted. (Doc. No. 12 .) This c ase shall be remanded to the Stark County Court of Common Pleas. Plaintiffs' request for sanctions for improper removal (Motion at 1008) is denied. The Court finds that, given the unique circumstances resulting from the case management schedule in place at the time, defendants had a colorable basis to remove this case based upon the content of the expert reports that were submitted by the October 2015 deadline but before the close of fact discovery. Filing 25 Memorandum Opinion and Order: The Court concludes that defendants have not satisfied their burden to show that plaintiffs abandoned their claims against the Ohio defendants. Plaintiffs' motion to remand is granted. (Doc. No. 12 .) This c ase shall be remanded to the Stark County Court of Common Pleas. Plaintiffs' request for sanctions for improper removal (Motion at 1008) is denied.
