Filing 44 Memorandum of Opinion and Order For the reasons set forth herein, Plaintiffs' Motion for Indicative Ruling Pursuant to Fed. R. Civ. P. 62.1 (ECF No. 41 ) is granted in part, and denied in part. The Court denies Defendant's request to issue a ruling indicating that Defendant's motion for relief from judgment raises a substantial issue and that, on remand, the Court would grant the motion. The Court indicates and hereby certifies under Fed. R. Civ. P. 62.1(a)(2) that it de nies Defendant's Motion for Relief from Judgment or Order, Pursuant to Fed. R. Civ. Defendant's counterclaims are denied and dismissed with prejudice. Accord ingly, the Court declares that Plaintiff LM Insurance has no obligation to satisfy the judgment in Defendant's Underlying Action against non-party Empire Die Casting Co., Inc. for employer intentional tort and premises liability.
