Memorandum Opinion and Order: The emergency motion (Doc. Nos. 142 / 143 ) of defendant Northfield Park Associates, LLC is granted, and the Extended Agreed Order (Doc. No. 21 ) is modified as follows to permit Northfield Park Associates, LLC to: (See Opinion for details). In anticipation of defendant's possible decision to make operational changes to the backstretch, the Court advises that it will, in that event, appoint a special master to supervise the process.
