January 28, 2020 Opinion or Order Filing 57 Memorandum Opinion and Order For reasons set forth in this order, Plaintiffs' Amended Motion for Judgment on the Administrative Record (Doc. No. 49) is DENIED. The CFCSD Defendants' request that this Court dismiss Counts II a nd II of the Complaint (Doc. No. 55-1 at p. 27) is GRANTED. Counts II and III of the Complaint are hereby DISMISSED. Defendants' request that this Court issue a show cause order why the Dougalls attorney should not be liable to Copley-Fa irlawn for attorneys fees in this action pursuant to 20 U.S.C. 1415(i)(3)(B) is DENIED. The CFCSD Defendants have not shown that the instant action is frivolous, unreasonable, or without foundation, or presented for an improper purpose such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation. March 18, 2019 Opinion or Order Filing 42 Memorandum Opinion and Order: Plaintiffs' motion to supplement the administrative record (Doc. No. 36 /36-1) is denied with the following caveat. Following this Court's review of the administrative proceedings encompassed by Count s I, II, and III of the complaint, should any party desire to supplement the record with any additional documents relevant to the merits of the claims in Counts VVIII, the Court will entertain (although it is not inviting) an appropriate, timely moti on setting forth good cause for limited supplementation. Pursuant to the Court's Order dated August 15, 2018, plaintiffs' opening brief with respect to Counts I, II, and III is now due by April 2, 2019; defendants' response brief will be due May 28, 2019; plaintiffs' reply will be due June 25, 2019.
