Memorandum of Opinion and Order For the reasons stated in the Order, Plaintiff's Motion to Amend his Complaint (Doc. # 12 ), Motion to Amend Service (Doc. # 10 ), and a Motion to Amend and Correct Docket of Government (Doc. # 11 ), and a Motion to Proceed In Forma Pauperis (Doc. # 14 ) are granted. Plaintiff's Motion for Appointment of Counsel (Doc. # 7 ) is denied. Defendant's Motion to Dismiss (Doc. # 5 ) is granted. This action is dismissed for lack of subject matt er jurisdiction, and for failure to state a claim upon which relief may be granted.
