Filing 17 Order: Pursuant to LR 16.4, Alternative Dispute Resolution (ADR), of the Local Rules of the United States District Court for the Northern District of Ohio, and at the parties' joint request (see Letter, Doc. No. #16 ), the above-captioned case is hereby referred to Mediation pursuant to LR 16.6(a), et seq. The Court refers this case to Magistrate Judge George J. Limbert for mediation/settlement. As discussed at the Case Management Conference (see Minutes of Proceedings, 8/22/18), the parties will engage in some limited discovery. Minutes of proceedings [non-document]. The telephonic Case Management Conference was conducted on 8/22/2018 by Judge Sara Lioi. Attorneys Brian Mertes and Whitney Willits participated on behalf of plaintiff; Attorneys Lawrence Del Rossi, Matthew Fontana, and Jeffrey Hinebaugh participated on behalf of defendant. No party representatives were required to participate. Counsel advised the Court of their desire to conduct some limited discovery, followed by mediation, in hopes of an early resolution of this case. Plaintiff anticipates deposing the defendant and his current supervisor at non-party Johnson Controls (Mike Moran); defendant anticipates conducting a Rule 30(b)(6) deposition of plaintiff (hopefully Robert Raymond, defendant's former supervisor). This and any other necessary limited discovery shall be completed by 10/26/2018. Mediation following the discovery shall be completed by 11/16/2018 and counsel shall keep the Court informed as to the outcome. By 8/31/2018, counsel shall jointly inform the Court as to whether they prefer using the court's ADR services, the assigned magistrate judge, or private mediation. All parties and counsel, as well as the Court, agree that the state court's 6/19/2018 Temporary Restraining Order (Doc. No. 1-1 at Page ID# 44), as extended by the state court's 6/28/2018 Order maintaining the TRO in effect until further order (Doc. No. 1-1 at Page ID #46), shall continue to control. Should the case not be resolved following the above procedure, the Court will reconvene the Case Management Conference to set the remaining deadlines.
