Minute Order [non-document]. The Court conducted a telephonic conference on July 23, 2021 concerning plaintiffs' motion for a temporary restraining order and preliminary injunction. (Doc. No. 2 .) Attorneys Braga and Congeni participated on behalf of plaintiffs. Attorneys Abens, Harvey, and Yusko participated on behalf of defendant Baxter. Attorneys Becker and Garritano participated on behalf of defendant Zenith Systems. In response to plaintiffs' motion for injunctive relief, defendant Baxter filed a motion to strike which indicates that there is a case pending in the Summit County Court of Common Pleas where defendant expected plaintiffs' motion for injunctive relief to be filed, and attached certain state court documents from the Summit County case. (Doc. No. #8 .) The Court reviewed the state court documents prior to the conference call. At the outset of the conference, the Court raised the issue of whether, given the pending state court action, this action was properly before the Court pursuant to the Colorado River abstention doctrine announced by the United States Supreme Court in Colorado River Water Conservation Dist. v. United States, 424 U.S. 800, 96 S. Ct. 1236, 47 L. Ed. 2d 483 (1976), and then discussed the necessity of resolving that issue prior to acting upon plaintiffs' motion for injunctive relief. After discussion, counsel for both sides agreed upon a briefing schedule to address the issue of whether this matter is properly before the Court prior to any action by the Court on plaintiffs' motion for injunctive relief. Any motion by defendants on the issue of whether this case is properly before the Court must be filed no later than 12:00 noon on August 3, 2021. Any response by plaintiff is due August 13, 2021, and any reply by defendants is due August 18, 2021. Judge Sara Lioi on 7/23/2021. (E,CK)
