| Proceeding memo: 3/27/24 Hearing held on first day motions in Chapter 11, Subchapter V case of Joe's Drain Cleaning, LLC ("Debtor"). The Court heard testimony from Joseph Conway, the Debtor's president and sole member, and Exhibits 112 were admitted without objection. First addressing the Debtor's cash collateral motion #5, the Court noted that the proposed order attached to that motion would only grant replacement liens to one creditor (the Small Business Administration). After discussion, Debtor's counsel agreed that the order should be amended to grant replacement liens to all creditors who may have an interest in the Debtor's cash collateral. With that change, the Court stated that it would grant the Debtor's cash collateral motion on an interim basis. Debtor's counsel to upload a proposed interim order granting the cash collateral motion, subject to the revisions discussed on the record. As for the Debtor's utility motion #6, Mr. Wheatley, on behalf of the United States Trustee, objected to the motion to the extent granting it would result in utility providers being paid for prepetition services. Debtor's counsel and the Subchapter V Trustee argued that granting the utility motion was necessary to avoid significant disruption to the Debtor's business operations and reorganization. For the reasons stated on the record, the Court will grant the Debtor's utility motion on an interim basis. Debtor's counsel to upload a proposed interim order granting the utility motion, subject to the revisions to paragraph nine discussed on the record.
