Filing 46 OPINION AND ORDER by Judge Ronald A. White : Defendant Cherrie Guay is DISMISSED WITHOUT PREJUDICE for Plaintiff's failure to properly serve her. Defendants are GRANTED summary judgment for Plaintiff's claims conce rning his medical treatment, the threat of pepper spray, and the claim concerning missing property. Plaintiff's conspiracy claim is DISMISSED WITH PREJUDICE pursuant to 28 U.S.C. 1915(e)(2)(B) as frivolous or malicious and for failure to state a claim upon which relief may be granted. Plaintiff's request for injunctive relief is DENIED. This dismissal shall count as a "prior occasion" or "strike", pursuant to 28 U.S.C. 1915(g).(acg, Deputy Clerk) |
