MINUTE ORDER by Magistrate Judge Kimberly E. West: Denying Petitioner's motion for trial transcripts and other documents at public expense #13 . Petitioner has failed to allege precisely why he needs the particular documents, except to prepare a brief. He is reminded, however, that on January 17, 2020, the Court directed him to file only one brief in support of his habeas petition 7 and he already has filed the brief #12 . If a second brief is necessary, Petitioner must request leave from the Court to file a supplemental brief, explaining why his original brief is insufficient. A federal habeas petitioner does not have a constitutional right to access a free transcript in order to search for error. Ruark v. Gunter, 958 F.2d 318, 319 (10th Cir. 1992) (citing Hines v. Barker, 422 F.2d 1002, 1006-07 (10th Cir. 1970)). Further, habeas review under 28 U.S.C. 2254 is limited to the record that was before the state court that adjudicated the claim on the merits. Cullen v. Pinholster, 563 U.S. 170, 181-82 (2011)). If the Court later determines that additional documents are needed to resolve this habeas case, it will order their production. (acg, Deputy Clerk)
