Filing 17 MINUTE ORDER by Magistrate Judge Kimberly E. West: This Court acknowledges the filing of Plaintiff's "Motion to Deny Motion to Dismiss Filed Under Duress in Need of Extension of Time Due to Back Surgery" (Docket Entry #16 ). Within this document, Plaintiff states that she should be granted an extension to respond to Defendant's Motion to Dismiss due to the timing of a back surgery which did not permit her adequate time to prepare her response. Plaintiff also, however, provides a lengthy substantive response to the allegations contained within the Motion to Dismiss. Out of an abundance of caution, this Court will construe Plaintiff's filing as a Motion for Extension of Time to Respond to Defendant's Motion to Dismiss and grant Plaintiff, who appears pro se in this action, a brief extension of time to submit what she considers to be an appropriate and thorough response. Accordingly, the request for extension is GRANTED and Plaintiff shall file her complete response to Defendant's Motion to Dismiss no later than FEBRUARY 22, 2022. Defendant's deadline to file a reply is correspondingly extended. (rak, Deputy Clerk) |
