MINUTE ORDER by District Judge Ronald A. White : On December 2, 2024, the Court dismissed this action for Petitioners failure to prosecute. (Dks. 7, 8). He, however, had notified the Court of his change of address prior to the dismissal. (Dkt. 6). This case, therefore, is reopened, and the Court Clerk is directed to send Plaintiff the Opinion and Order entered on October 29, 2024 (Dkt. 4) that directed him leave to file an amended complaint on the Court's form as directed. Plaintiff is granted twenty-one (21) days from the entry of this Order to file the amended complaint. Failure to comply with this Order will result in dismissal of this action without further notice. MINUTE ORDER by District Judge Ronald A. White : On October 29, 2024, Plaintiff was mailed an Order directing him to file an amended complaint by November 19, 2024 (Dkt. 4). On November 18, 2024, however, the mail was returned to the Court marked "Return to Sender-No Such Number-Unable to Forward." (Dkt. 5). Pursuant to Local Civil Rule 5.6(a), Plaintiff is required to notify the Court of any address changes. Because Plaintiff has failed to comply with this requirement, this action is dismissed without prejudice for failure to prosecute. See United States ex rel. Jimenez v. Health Net, Inc., 400 F.3d 853, 854-56 (10th Cir. 2005) (dismissing appeal sua sponte for failure to prosecute because appellant disappeared and failed to meet court deadlines). (acg, Deputy Clerk)
