OPINION AND ORDER by Chief Judge Claire V Eagan that plaintiff may file a second amended complaint realleging his claims against Shaw and Maxwell only no later than February 24, 2012. If plaintiff fails to file a second amended complaint curing t he deficiencies noted in this Opinion and Order, this action will be dismissed without prejudice for failure to state a claim. Defendants Captain Jeri Shaw and Undersheriff Mike Waters' Motion to Dismiss Plaintiff's Complaint and Brief in Support (Dkt. # 25) is granted. Plaintiff's claims against Waters are dismissed with prejudice, but his claims against Shaw are dismissed without prejudice. Defendant Jailer Beverly Maxwell's Motion to Dismiss Plaintiff's Amended Complaint and Brief in Support (Dkt. # 39) is granted, and plaintiffs claims against Maxwell are dismissed without prejudice. ; terminating party Mike Waters ; setting/resetting deadline(s)/hearing(s): ( Miscellaneous Deadline set for 2/24/2012); granting 39 Motion to Dismiss; granting 25 Motion to Dismiss (Re: 1 Complaint, 16 Amended Complaint ) (RGG, Chambers)
