OPINION AND ORDER by Chief Judge Claire V Eagan that Plaintiff's civil rights complaint (Dkt. # 1) is dismissed without prejudice for failure to state a claim upon which relief may be granted pursuant to 28 U.S.C. § 1915(e)(2)(B). The Clerk is directed to flag this dismissal as Plaintiff's second "prior occasion" for purposes of 28 U.S.C. § 1915(g). Plaintiff remains obligated to pay in monthly installments $568.45, the balance owed on the filing fees for both this case and Case No. 09-CV-017-GKF. (Re: 1 Complaint ) (RGG, Chambers)
